Thinking about adoption can be a big decision. The following information is not a complete list of the laws we adhere to when helping you with an adoption plan, but this is a good summary of the important things to know about adoption laws in Washington state.

Who Needs to Okay the Adoption?

In Washington, most of the time, the following people need to agree to the adoption for it to happen:

  • You (the birth mom)
  • The baby’s dad (if known)

You’ll need to sign a paper agreeing to the adoption. This paper can’t be used right away, though. You have 48 hours to change your mind after signing it or 48 hours after the baby is born, whichever comes later. There are some special rules for Native American children.

The paper you sign will say a few things:

  • That a judge has to approve the adoption
  • That you can change your mind before the judge says yes
  • Whether you and the baby’s dad are Native American or Alaskan Native

Someone you trust, 18 or older, needs to be there when you sign the adoption papers. They’ll write down their name and address on the paper.

Can Someone Be Forced to Give Up a Child?

The court can decide to let the adoption happen even if someone who usually needs to agree doesn’t, if the judge thinks it’s the best thing for the child. This can occur if the person hasn’t been taking care of the child or has hurt them in the past.

What Rights Does the Baby's Dad Have?

The baby’s dad usually has a say in the adoption if he’s married to you when the baby is born or if he lived with you and the baby. There are other ways the dad might have rights, too, but this is an excellent general rule.
